The Provision of the Personal Data Protection Authority no. 229 of 8 May 2014, published in the Official Gazette on 3 June 2014, classified cookies under two macro-categories: “technical" cookies and “profiling” cookies.
a. Technical cookies.
Technical cookies are used for the sole purpose of “transmitting a communication on an electronic communication network, or to the degree strictly necessary for a supplier of a service of an information company explicitly requested by the subscriber or by the user in order to deliver this service" (see article 122, paragraph 1 of the Code).
They are not used for other purposes and are usually installed directly by the owner or provider of the website. They can be divided into navigation or “session” cookies, which ensure the normal navigation and use of the website (enabling, for example, a purchase to be made or authentication to be carried out in order to access restricted areas); analytic cookies, similar to technical cookies, which are used directly by the website provider to collect information, in aggregate form, on the number of users and how they visit the website; and functionality cookies, that enable the user to navigate on the basis of a series of selected criteria (for example, the language, the products selected for purchase) for the purpose of improving the service delivered.
The user’s consent in advance is required for these cookies to be installed.
b. Profiling cookies.
Profiling cookies are intended to create profiles of the user and are used for the purpose of sending advertising messages in line with the preferences displayed while navigating the internet. Due to the invasive nature these devices may have in the user’s private sphere, European and Italian regulations lay down that the user must be adequately informed about their use and give their consent.
In reference to these cookies, article 122 of the Code lays down that “the storage of information in the equipment of a contracting party or a user, or access to information already stored, is only permitted on condition that the user has given his/her consent after having been informed with the simplified procedures referred to in article 13, paragraph 3” (article 122, paragraph 1, of the Code).
In the same Provision, the Authority also categorised cookies according to the subject who acts as Data Controller of the personal data collected by cookies, distinguishing between first-party and third-party cookies.
1. First-party cookies.
These are cookies managed by the owner of the website. For these cookies, the obligation to inform users is the responsibility of the owner of the website. The latter is also obliged to indicate the methods by which cookies can be blocked.
2. Third-party cookies.
These cookies are managed by a third party, other than the owner of the website. For these cookies, the obligation to inform the user and indicate the methods by which cookies can be blocked is the responsibility of the third party, while the owner of the website is obliged to include on the website a link to the third-party website, where these elements are available.
For both types of cookies (first-party or third-party), should the cookie be a profiling cookie, consent must be obtained by means of the appropriate banner on the website's home page.
