GENERAL INFORMATION ON REGULATIONS CONCERNING CONSENT TO THE USE OF COOKIES

Italian law (article 122 of the Legislative Decree 196/03) enshrined a European Directive in our legal system that lays down the obligation on providers of websites that use cookies or other monitoring technologies to inform the user about the types of any cookies used by the website.

The Provision of the Personal Data Protection Authority no. 229 of 8 May 2014, published in the Official Gazette on 3 June 2014, classified cookies under two macro-categories: “technical" cookies and “profiling” cookies.

a.      Technical cookies.

b.      Profiling cookies.

In the same Provision, the Authority also categorised cookies according to the subject who acts as Data Controller of the personal data collected by cookies, distinguishing between first-party and third-party cookies. 

1. First-party cookies.

These are cookies managed by the owner of the website. For these cookies, the obligation to inform users is the responsibility of the owner of the website. The latter is also obliged to indicate the methods by which cookies can be blocked.

2. Third-party cookies.

These cookies are managed by a third party, other than the owner of the website. For these cookies, the obligation to inform the user and indicate the methods by which cookies can be blocked is the responsibility of the third party, while the owner of the website is obliged to include on the website a link to the third-party website, where these elements are available.
